Draft notice. This is an internal draft for legal review. Clauses marked [⚖ counsel] flag points that require a Belgian lawyer's input before publication — chiefly the limitation of liability, which cannot lawfully exclude everything under Belgian/EU law.


1. Who we are and what this covers

The AFD Knowledge MCP (the "Service") is a free, hosted Model Context Protocol server, reachable at https://mcp.afdinstitute.com, that lets an AI assistant query the Adaptive Flow Delivery ("AFD") methodology — its phases, gates, lexicon, roles, health model, templates, and comparisons. It also lets you contribute your own AFD case study or a structured, anonymised Project Record, if you choose to (see §5A).

The Service is operated by WLKNSN bv, a company incorporated in Belgium, trading as AFD Institute ("we", "us", "our"). These Terms of Use ("Terms") form a binding agreement between you ("you", "your", the "User") and us governing your access to and use of the Service.

By creating an AFD Institute account for the Service, or by accessing the Service while signed in with one, you confirm that you have read, understood, and agree to these Terms and to our Privacy Notice. If you do not agree, do not sign in and do not use the Service.

2. The Service is free, gated, and provided "as is"

  • Free. We make no charge for the Service. No payment, subscription, or purchase is required or accepted.
  • Gated. Access requires signing in with a free AFD Institute account (see §3), via OAuth, from your AI client. There is no anonymous access.
  • No warranty. The Service is provided "as is" and "as available", without warranty of any kind, whether express or implied, including (to the fullest extent permitted by law) any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
  • No SLA. We do not guarantee any level of availability, uptime, response time, or continuity. We may modify, rate-limit, suspend, or discontinue the Service, in whole or in part, at any time and without notice or liability.

3. Your AFD Institute account

  • Sign in with a free AFD Institute account. To use the Service you sign in with a free AFD Institute account via OAuth, from your AI client. Creating that account is free; you accept these Terms and the Privacy Notice as part of using the Service. There are no API keys.
  • Your account. Your account is personal to you. You are responsible for keeping your sign-in credentials confidential and for all activity that occurs under your account. Notify us promptly at hello@afdinstitute.com if you believe your account has been compromised.
  • Your use. Signing in authorises your own use of the Service through your AI assistant(s). It does not authorise you to operate the Service on behalf of third parties.

4. Acceptable use

You agree that you will not:

  • exceed the published rate limits, or attempt to circumvent, disable, or interfere with any rate-limiting, authentication, logging, or security measure;
  • use automated means to systematically download, scrape, mirror, or bulk-extract the content served by the Service in order to reconstruct, cache at scale, or republish the underlying dataset;
  • resell, sublicense, or commercially redistribute access to the Service or its responses;
  • use the Service to build, train, or improve a product or dataset that competes with the AFD methodology or the AFD Institute;
  • remove, obscure, or alter the attribution line included with responses;
  • use the Service in any way that is unlawful, infringes the rights of others, or imposes a disproportionate load on our infrastructure.

We may suspend or terminate your access at any time if we reasonably believe these Terms have been breached.

5. Intellectual property and licence

The AFD methodology, the AFD lexicon and definitions, the phase/gate model, the health model, templates, comparisons, and all content served by the Service (the "AFD Content") are the proprietary intellectual property of WLKNSN bv / AFD Institute and are protected by copyright and other laws. "Adaptive Flow Delivery", "AFD", and "AFD Institute" are marks of WLKNSN bv.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to query the Service and to use its responses for your own personal or internal business purposes — for example, to understand or apply the methodology in your work.

This licence does not permit you to redistribute, resell, publish, or sublicense the AFD Content, to strip its attribution, or to use it to build a competing methodology, dataset, or service. All rights not expressly granted are reserved.

5A. Contributing your own cases (the afd_submit_* tools)

The Service includes two optional contribute tools — afd_submit_use_case (a qualitative case study) and afd_submit_record (a structured, anonymised Project Record). Using them is entirely voluntary and is not required to query the methodology.

  • Signed in with your AFD Institute account. A contribution is written against your AFD Institute account — the same account you sign in with to use the Service — and may be curated into AFD Institute content. The tool returns a sign-in link if you are not signed in.
  • The licence you grant. What you submit is governed by the AFD Contribution Licence, which you accept at account onboarding. In summary, you grant AFD Institute the right to review, anonymise, and use contributed cases — including internally and, where you permit, in published form (the case library, benchmarks, research, and marketing). You retain ownership of your underlying project.
  • Moderation. Nothing you submit is auto-published. Every submission enters a review queue and stays private and anonymised by default unless you explicitly choose otherwise.
  • Your confidentiality warranty. Submit only material you have the right to share. Do not submit personal data about identifiable individuals, or confidential client information you are not authorised to disclose. You confirm this at submission.
  • Benchmark data. Project Records are stored anonymised; only cohort keys and scores feed the published benchmarks, and only at a minimum cohort size, so no single project is identifiable.

6. The content is informational — not professional advice

The AFD Content is provided for general informational and educational purposes only. It does not constitute professional, legal, financial, management, or project-delivery advice, and must not be relied upon as such. You are solely responsible for any decision you make or action you take based on it. Where appropriate, seek qualified professional advice for your specific circumstances.

7. AI-assistant output — important

The Service is consumed by third-party AI assistants (for example Claude, Cursor, ChatGPT, or GitHub Copilot) that we do not operate or control. Those assistants interpret, summarise, combine, and re-present the Service's responses in ways we cannot predict or govern.

Accordingly, we do not warrant that any output produced by your AI assistant — even where it draws on the Service — is accurate, complete, current, or fit for any purpose, and we are not responsible for how a third-party assistant uses, phrases, or presents the AFD Content, nor for any other content that assistant generates. Your use of any AI assistant is governed by that assistant provider's own terms.

8. Limitation of liability [⚖ counsel]

Counsel to finalise. Under Belgian and EU law, liability for death or personal injury, for fraud, and for gross negligence or wilful misconduct cannot be excluded, and consumer protections may limit the disclaimers below. The intended position is the broadest exclusion the law permits for a free, no-charge service.

To the maximum extent permitted by applicable law, and except for liability that may not lawfully be excluded:

  • the Service is provided free of charge, and we accept no liability for any loss or damage of any kind arising out of or in connection with your use of, or inability to use, the Service or any response it returns;
  • we are not liable for any indirect, incidental, special, consequential, or punitive damages, nor for any loss of profit, revenue, data, goodwill, or business, however caused;
  • our total aggregate liability to you for all claims connected with the Service shall in no event exceed one hundred euros (€100) or, if greater is required by law, the minimum the law requires.

Nothing in these Terms excludes or limits our liability where doing so would be unlawful.

9. Indemnity

You agree to indemnify and hold harmless WLKNSN bv and AFD Institute from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your infringement of any third-party right.

10. Suspension and termination

You may stop using the Service at any time and may request deletion of your Service data (see the Privacy Notice). We may suspend or terminate your access, or discontinue the Service at any time, with or without cause, and without liability. Sections 5–9 and 11–12 survive termination.

11. Changes to these Terms

We may update these Terms from time to time. The Version and Last updated fields above indicate the current revision. Where a change materially affects your rights or obligations, we will require you to accept the updated Terms before continuing to use the Service. Continued use after a non-material update constitutes acceptance.

12. Governing law and jurisdiction

These Terms are governed by the laws of Belgium, without regard to conflict-of-law rules. The courts of Belgium have jurisdiction over any dispute arising from or relating to these Terms or the Service, without prejudice to any mandatory consumer-protection rights you may have to bring proceedings in your country of residence.
